Spanish judge says she is not a journalist and cannot investigate Spanish courts

A Spanish court has ruled that the judge who oversaw the prosecution of the Spanish politician accused of plotting to assassinate the country’s president could not be prosecuted.

The decision by the Spanish Constitutional Court (CSIC) comes after a two-year legal battle to determine whether Elena Núñez can be prosecuted for alleged crimes committed during the 2016 elections.

The CSIC said on Tuesday it had decided to uphold the decision by an appeals court that found the charges were not criminal enough.

“The Constitutional Court has reached the conclusion that Elena Nueva, who was charged in 2017 with involvement in the attempt to assassinate (then-President) Mariano Rajoy, does not have a sufficient connection to the events of 2017 to be charged with an offence,” the court said in a statement.

The Spanish Foreign Ministry did not immediately respond to requests for comment.

The court said the alleged plot to assassinate Rajoy was “completely different” from a previous charge of inciting terrorism, which had been withdrawn following the arrest of Nuevo Leon, a member of the far-right party Podemos.

“Elena Nuevas alleged participation in the conspiracy is completely different from a similar conspiracy in 2016.

That was clearly a different act from that alleged in 2017,” the CSIC wrote.

Nueva’s lawyer said her client was not guilty of any crime and had no intention of interfering in the internal affairs of Spain.

A court had previously found her guilty of organizing an illegal demonstration, but a new judge said the case was flawed because she was not a witness to the plot.

The case comes amid a political storm in Spain, where a new anti-corruption investigation is under way.

Nuñez, who is a member in the leftist Popular Party, was charged with conspiracy to commit murder, conspiracy to attack public buildings, inciting violence and organizing a crime.
